EPA (2023) narrowed the definition of "waters of the United States," many privately owned, isolated retention ponds, process ponds and irrigation ponds fall outside federal wetlands jurisdiction and outside Rivers and Harbors Act navigability rules. When that's true for your site, the federal wetlands and navigability permits simply don't apply.
